These Terms of Use ("Terms") govern your access to and use of the RTC Abstracts portfolio website (the "Site"), operated by CROS3 LLC d/b/a RTC Abstracts ("RTC Abstracts," "we," "us," or "our"). By accessing or using the Site after these Terms become effective, you agree to these Terms. If you do not agree, do not use the Site.
1. Portfolio and Informational Purpose
The Site presents RTC Abstracts photographic artwork and related informational creative/design services. It is intended for personal viewing and discovery of portfolio content.
RTC v1 does not provide active checkout, payment processing, customer accounts, order placement, fulfillment, refunds, shipping, favorites, loyalty features, or contact-form submission. Artwork availability, pricing, purchase terms, transaction policies, shipping terms, taxes, fulfillment, and refunds are not offered through RTC v1 unless and until separately made available under applicable terms and policies.
2. Intellectual Property and Permitted Viewing
The Site, including its photographs, artwork images, artwork titles, descriptions, text, visual selection and arrangement, graphical presentation, design, logos, and other content, is owned by or used by RTC Abstracts, CROS3 LLC, or the applicable rights holder and is protected by applicable intellectual-property laws.
Subject to these Terms, RTC Abstracts grants you a limited, revocable, non-exclusive, non-transferable right to access and view the Site and its portfolio content for personal, non-commercial viewing. This limited permission does not transfer ownership of any content.
Except with prior written permission from the applicable rights holder or as permitted by applicable law, you may not copy, reproduce, download, republish, distribute, display, transmit, sell, license, create derivative works from, commercially exploit, or otherwise use Site content, including photographs and artwork images, for a purpose outside personal, non-commercial viewing.
Nothing in these Terms claims ownership of third-party intellectual property. References to RTC Abstracts, CROS3 LLC, or related names and marks are not a claim that any mark is registered unless expressly stated elsewhere by an authorized rights holder.
3. Prohibited Technical and Content Misuse
You may not use the Site in a way that interferes with, disrupts, damages, overloads, probes, or circumvents the Site or its security. You may not attempt to gain unauthorized access to any system, account, data, administrative function, or service; introduce malicious code; bypass access controls; scrape, harvest, index, archive, or use automated means to extract Site content at scale without prior written permission; or use Site content for unlawful, infringing, deceptive, or unauthorized commercial purposes.
4. Artwork Information and Site Content
RTC Abstracts aims to present portfolio information accurately. Artwork images, titles, descriptions, locations, and related content may be revised, corrected, removed, or updated without notice. Differences in screens, devices, browsers, display settings, reproduction methods, or future print processes may affect how color, scale, texture, crop, or other visual characteristics appear. The Site is informational and does not constitute a current offer to sell, a guaranteed availability statement, or a commitment to provide a particular artwork, service, commission, price, edition, format, or outcome.
5. Art Advisory Boundary
RTC Art Advisory is limited to informational creative/design guidance concerning artwork selection, sizing, placement, aesthetic coordination, artistic/design collection development, commissions, and hospitality or commercial presentation. It is not investment advice, securities advice, tax advice, financial planning, legal advice, a valuation, a guaranteed valuation, or a guarantee of appreciation or financial performance. Any future engagement, commission, transaction, or service arrangement may be subject to separate written terms.
6. Third-Party Links and Services
The Site may link to third-party websites or services for convenience. RTC Abstracts does not control and is not responsible for those third parties, their content, availability, privacy practices, terms, or actions. Your use of a third-party website is governed by that third party’s terms and policies.
7. Availability, Disclaimers, and Limitation of Liability
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, RTC Abstracts disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation, except to the extent a disclaimer is not permitted by applicable law.
To the maximum extent permitted by applicable law, CROS3 LLC and RTC Abstracts will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, profits, or business opportunity arising from or related to use of, or inability to use, the Site.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. These Terms do not establish a fixed dollar liability cap for RTC v1.
8. Changes to the Site and Terms
RTC Abstracts may change, suspend, remove, or update Site content, features, availability, or these Terms at any time. If we make material changes to these Terms, we will post the revised Terms with an updated effective date and provide any additional notice required by applicable law. Continued use of the Site after the revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
9. Governing Law and Venue
These Terms and any dispute arising out of or relating to the Site or these Terms will be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to applicable law, any judicial proceeding arising out of or relating to the Site or these Terms will be brought in an appropriate state or federal court located in the Commonwealth of Virginia.
10. Arbitration, Class Actions, and Indemnification
RTC v1 does not include a mandatory arbitration provision, class-action waiver, jury-trial waiver tied to arbitration, alternative-dispute-resolution restriction, or standalone visitor indemnification clause. These subjects may be reconsidered only through a future owner/legal decision if RTC introduces materially different interactions, including commerce, accounts, public uploads, community content, or contractual commission workflows.
11. Copyright and Intellectual-Property Inquiries
If you believe that material on the Site infringes your copyright or another intellectual-property right, contact legal@rtcabstracts.com. RTC v1 does not claim formal DMCA designated-agent status, a registered copyright-agent process, or a statutory takedown mechanism that has not actually been established.
12. General Terms
If a provision of these Terms is unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law. These Terms do not create an employment, agency, partnership, joint venture, or other relationship between you and RTC Abstracts. A failure to enforce a provision is not a waiver of that provision.
